2. Privacy & Confidentiality
2.1 Data Handling
- Patient data processed by the model must be anonymized and encrypted end-to-end.
- Data storage and processing must comply with all applicable privacy regulations, including but not limited to HIPAA and GDPR.
2.2 Prohibited Uses
- No identifiable patient data may be used for model training without explicit consent from the patient or their legal representative.
- Third-party data sharing is strictly prohibited unless required by law or regulatory authorities.
3. Transparency & Accountability
3.1 Documentation
- Publicly disclose:
- Training data sources (excluding private patient data).
- Known algorithmic limitations, risks, and biases.
- Clinical validation studies demonstrating the model's efficacy and safety.
3.2 Audit Logs
- Maintain immutable logs of AI-generated recommendations to ensure traceability for clinical review and regulatory compliance purposes.
4. User Responsibilities
4.1 Professional Integrity
- Users must:
- Disclose the involvement of AI in patient care to patients or their legal representatives where applicable.
- Avoid over-reliance on AI outputs during high-risk situations, such as those involving suicidal ideation or other emergencies requiring immediate human intervention.
4.2 Reporting Obligations
- Production users (this includes clinicians, websites, and companies) are required to report errors, biases, or harmful outputs directly to Alex Scott, the owner of namelessai/Helply-10.2b-chat, at [email protected], within 72 hours of discovery. I highly recommend that regular (personal, e.g. an ai enthusiast NOT A CLINICIAN) report them as well.
5. Enforcement
5.1 Reporting Violations
- All violations of this Code of Conduct must be reported to Alex Scott at [email protected], who will review each case and determine appropriate actions to address the issue.
5.2 Penalties for Misuse
- Penalties for misuse may include license revocation, prohibition from further use of the model, or legal action in cases of intentional harm or negligence.
6. Legal Compliance and Liability
- This Code of Conduct is governed by the laws of North Carolina, USA, or other applicable jurisdictions as determined by the user's location and usage context.
- Users assume full liability for any unapproved modifications to the model or misuse that results in harm.
7. Amendments
- Revisions to this Code of Conduct will be made at the discretion of Alex Scott and will require a public notice period of no less than 60 days before taking effect.
